Terms of Service

1. USER ACCEPTANCE

Welcome to Destinify. This is a legally binding agreement between Destinify LLP ("Company," "we," "us," or "our") and you ("User," "Traveler," or "Service Provider").

By accessing or using the Destinify website (Destinify.com) or mobile application (the "Platform"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, please cease using our Platform immediately.

2. SERVICE DESCRIPTION & ROLE OF DESTINIFY

2.1 The Unified Platform: Destinify acts as a technology platform that connects Travelers with Service Providers ("Providers") to discover, map, and organize travel experiences. We help users bridge the gap between social inspiration and real-world booking.

2.2 Intermediary Status: Destinify is an "Intermediary" under the Information Technology Act, 2000. We do not own, sell, resell, furnish, control, manage, offer, deliver, or supply any travel services. The Service Provider alone is responsible for their Services. When a Traveler books a Service, they are entering into a contract directly with the Provider. Destinify is not a party to that contractual relationship.

3. ACCOUNTS & ELIGIBILITY

3.1 Eligibility: By registering, you represent that you are at least 18 years of age. If you are under 18, you may only use the Service under the supervision of a parent or legal guardian.

3.2 Data Collection: During registration, we collect data including your name, email, and mobile number. We may verify this information to maintain Platform security.

3.3 Account Security: You are responsible for maintaining the confidentiality of your login credentials. We reserve the right to suspend or terminate accounts that violate these Terms without prior notice.

4. USER CONDUCT & PROHIBITED CONTENT

This section is updated to comply with Rule 3(1)(b) of the IT Rules, 2021.

You agree NOT to host, display, upload, modify, publish, transmit, store, update, or share any information or "Content" (text, photos, videos, reviews) that:

• Belongs to another person and to which you do not have any right.
• Is defamatory, obscene, pornographic, paedophilic, invasive of another's privacy, including bodily privacy, insulting or harassing on the basis of gender, libellous, racially or ethnically objectionable, relating or encouraging money laundering or gambling, or otherwise inconsistent with or contrary to the laws in force.
• Is harmful to children.
• Infringes any patent, trademark, copyright, or other proprietary rights.
• Deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any information which is patently false or misleading in nature but may reasonably be perceived as a fact.
• Threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order.

5. DISCLAIMER: MAPS & HIDDEN GEMS

5.1 Accuracy: Our services rely on user-generated content and third-party data (e.g., Google Maps). While we strive for accuracy, we cannot guarantee that location data for "Hidden Gems" or tours is 100% precise.

5.2 Risk: You acknowledge that visiting locations discovered on Destinify is at your own risk. We are not liable for any physical injury, property damage, or safety hazards encountered at these locations.

6. INTELLECTUAL PROPERTY & CONTENT RIGHTS

6.1 Your Content: You own the content you submit. However, by posting content (e.g., "Moments," reviews), you grant Destinify a non-exclusive, worldwide, royalty-free, perpetual license to use, display, reproduce, and distribute your content for operating and marketing the Platform.

6.2 Our IP: The design, trademarks, and code of Destinify are owned by us. You agree not to copy, reverse engineer, or scrape our Platform without written permission.

7. BOOKING & PAYMENTS

7.1 Direct Transactions: Destinify currently operates on a Zero Commission model. We facilitate the connection, but all financial transactions for bookings occur directly between the Traveler and the Service Provider.

7.2 Refunds: Destinify does not hold funds and has no authority to issue refunds. Refund requests must be directed to the Service Provider.

8. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Destinify LLP shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages resulting from:

• Errors, mistakes, or inaccuracies of content.
• Personal injury or property damage resulting from your use of the Platform.
• Any unauthorized access to our secure servers.
• Any bugs, viruses, or trojan horses transmitted through our Platform by third parties.

9. INDEMNITY

You agree to defend, indemnify, and hold harmless Destinify LLP from any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Platform or your violation of these Terms.

10. GOVERNING LAW

These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Kerala, India.
